The legal basis for processing personal data for the purposes described in the marketing purpose is the user's consent.

In the event that there is a prior contractual relationship with the user, provided that ASSISTCARGO had lawfully obtained the recipient's contact details and used them to send commercial communications relating to products or services of its own company that are similar to those which were initially the subject of the contract with the customer, the legal basis of the processing shall be based on legitimate interest, with special reference to the provisions of the second paragraph of Article 21 of Law 34/2002, of 11 July, on information society services and electronic commerce.

ASSISTCARGO has a legitimate interest in carrying out quality surveys with users, in order to analyse user satisfaction with this website, the quality of customer service or the contracted products and/or services.

For the provision of the service, it is possible that the Company may contract the services of technology providers (data processors) located in countries outside the European Economic Area (EEA).

In these cases, the Company will ensure that such transfers are made under one of the appropriate safeguards provided for in the GDPR, such as the execution of Standard Contractual Clauses (SCC) approved by the European Commission, ensuring a level of protection equivalent to the European one.

The user shall have the right to request ASSISTCARGO to restrict the processing of personal data, always taking into account the requirements laid down in the legislation in force.

RIGHT TO PORTABILITY

The user shall have the right to receive from ASSISTCARGO the personal data concerning the user in a structured, commonly used and machine-readable format, and to transmit them to another controller where the processing is based on consent or a contract, and is carried out by automated means.

RIGHT TO OBJECT

The user has the right to object to ASSISTCARGO processing personal data concerning the user when such data are subject to processing based on public or legitimate interest. In such case, ASSISTCARGO will stop processing the data, except for compelling legitimate grounds or the exercise or defence of possible claims.

AUTOMATED INDIVIDUAL DECISIONS

The user shall have the right not to be subject to decisions based solely on automated processing, including profiling, which produces legal effects on the user or similarly significantly affects the user, always taking into account the requirements laid down in the legislation in force.

RIGHT TO LODGE A COMPLAINT

The user has the right to lodge a complaint with the Spanish Data Protection Agency if the user considers that the rights set out above in this privacy policy are infringed or if the user considers that the processing of personal data concerning the user infringes Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016, and Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights.

Social Media

ASSISTCARGO is present on the main social networks: Facebook, Instagram and LinkedIn.. For this reason, it assumes the role of Data Controller of the data posted on its profiles derived from friends, likes, followers or subscribers, comments, pins, etc.

The user expressly accepts being subject to the conditions and terms that, in terms of privacy, are set out by the different social networks or platforms where ASSISTCARGO is present, empowering it to use the means that the networks themselves allow in order to inform users about the different activities and services it carries out.

Minors

Minors under 14 years of age may not use the services available on this website without the prior authorisation of their parents, guardians or legal representatives, who shall be solely responsible for all acts carried out through this website by the minors in their care, including the completion of forms with the personal data of such minors and, where appropriate, ticking the boxes accompanying them.

In this regard, and insofar as ASSISTCARGO is unable to control whether users are minors or not, it shall be the parents, guardians or legal representatives who enable the necessary mechanisms to prevent minors from accessing this website and/or providing personal data without their supervision, ASSISTCARGO not admitting any responsibility in this respect.

This Privacy Policy may be updated at any time based on the needs of the website itself and future legislative changes regarding privacy, ASSISTCARGO reserving this right exclusively.
